PANDORA GIFT CARDS T&Cs

These terms and conditions ("Gift Card Terms") tell you the legal terms and conditions, which apply to the purchase and use of physical and digital PANDORA gift cards ("Gift Cards").

These Gift Card Terms apply to pounds sterling Gift Cards purchased online through the Pandora UK Website (https://uk.pandora.net/en) ("Pandora UK Website") as well as Gift Cards purchased at a participating physical Pandora UK-branded store.

Please read these Gift Card Terms carefully before purchase to ensure that you understand how Gift Cards work and that you are familiar with any restrictions, which may apply to their use.

Our Gift Cards are issued and managed by EML Payments Europe Limited ("EML"). By purchasing a Gift Card (whether in a Participating Store (defined below) or through the Pandora UK Website) you agree to comply with EML's Cardholder Agreement. Please read the EML Cardholder Agreement for details about how EML process your personal data.

For online Gift Card purchases, the the Pandora UK Website Terms and Conditions will apply to you in addition to these Gift Card Terms. If there is a conflict between these Gift Card Terms, the EML Cardholder Agreement, and the Pandora UK Website Terms and Conditions, these Gift Card Terms shall take priority between us and you.

These Gift Card Terms may be amended from time to time. Whenever you purchase Gift Cards, please check these Gift Card Terms to ensure you understand the terms and conditions, which will apply at that time.

References in these Gift Card Terms to "we", "us" and "our" shall mean (as applicable) Pandora UK.

1. IN-STORE PURCHASES


1.1 You may purchase physical Gift Cards at any participating Pandora UK-branded store in England, Scotland, Wales, Isle of Man, Jersey and Northern Ireland except airport stores ("Participating Store"). Physical Gift Cards cannot be purchased or used in the Republic of Ireland.


1.2 When you purchase a physical Gift Card at a Participating Store, the sale is made to you by Pandora Jewellery UK Limited, a company registered in England (company number 06654012) with its registered office at 33 George Street, London, W1U 3BH ("Pandora UK"). Pandora UK's VAT number is GB213663917.


1.3 Digital Gift Cards ("eGift Cards") are not available from a Participating Store and may only be purchased online through the Pandora UK Website.



2. ONLINE PURCHASES


2.1 You may purchase both physical Gift Cards and eGift Cards online through the Pandora UK Website. If you live in the Isle of Man or Jersey you cannot purchase physical Gift Cards online through the Pandora UK Website as we do not currently deliver to addresses in these locations. You can still purchase eGift Cards through the Pandora UK Website.


2.2 When you purchase a Gift Card online through the Pandora UK Website, the sale is made to you by Pandora Jewellery UK Limited, a company registered in England (company number 06654012) with its registered office at 33 George Street, London, W1U 3BH ("Pandora UK"). Pandora UK's VAT number is GB213663917.


2.3 After you place an online order for a Gift Card, you will receive an email acknowledging that we have received your order. This does not mean that we have accepted your order.


2.4 If we accept your order, we will confirm our acceptance by sending you a dispatch confirmation email confirming that your Gift Card has been dispatched. Our contract with you will come into effect at that point.


2.5 If we are unable to fulfil your order, for example, because physical Gift Cards are out of stock or because we cannot meet your delivery deadline, or for any other reason, we will not accept your order and will let you know by sending you an email to this effect. If you have already paid for your order, we will refund your payment for the Gift Card in full (including any delivery charges) to the credit or debit card you used to make the payment. We will process any refund due to you as soon as possible but in any case within 14 days of the date of our email to you.



3. ADDING A PERSONALISED MESSAGE


3.1 When purchasing an eGift Card, you will have the opportunity to provide a personalised message to be delivered to the recipient. Your message will appear in the email in which the eGift Card is delivered.


3.2 You are solely responsible for any message you ask us to include with your eGift Card. We reserve the right to refuse to deliver any message submitted by you if, in our sole discretion, your message is or is likely to be considered by any person to be defamatory, offensive, obscene, abusive, hateful, threatening, discriminatory, inflammatory, harmful, sexually explicit, deceptive, fraudulent, infringing of intellectual property rights or in any way unlawful.


3.3 If we reject your message for any reason, we reserve the right in our sole discretion to cancel your order and refund any payments you have made. If we send your order without your message, you will not be entitled to cancel your order by virtue of our decision not to send the message.


4. DELIVERY OF GIFT CARDS


4.1 Physical Gift Cards shall be delivered in accordance with the delivery terms set out in the Website Terms and Conditions. We do not currently deliver to Jersey or the Isle of Man.


4.2 eGift Cards shall be sent to the recipient's email address specified by you when you placed your order at or around the same time as our dispatch confirmation email is sent.


4.3 You are solely responsible for the accuracy of the information provided by you when you place your order and we have no liability to you or to the intended recipient in the event that your order is delivered to the incorrect address unless the error arises directly from our negligence or our breach of these Gift Card Terms or the Website Terms and Conditions.


4.4 We have no liability to you or to the intended recipient for the late or non-delivery of any eGift Card in circumstances where the late or non-delivery of the eGift Card arises from an interruption to or failure of your computer equipment (or any other electronic device), your internet connection or your ability to receive emails.



5. PRICE AND PAYMENT


5.1 For physical Gift Cards purchased in a Participating Store, the minimum amount that can be loaded on the card is £10.


5.2 For physical Gift Cards purchased online through the Pandora UK Website, the minimum purchase amount is £20. For eGift Cards, the minimum purchase amount is £10.


5.3 The maximum amount that can be purchased on any Gift Card is £500.


5.4 The price of Gift Cards includes VAT (where applicable) at the current rates chargeable in the UK for the time being but excludes delivery costs.


5.5 Delivery charges for physical Gift Cards are as notified to you during the checkout process, before you confirm your order. See our Delivery FAQ for more details. There is no delivery charge for eGift Cards.


5.6 Gift Cards purchased online through the Pandora UK Website must be paid for using a credit or debit card. Payment for your Gift Cards and all applicable delivery charges is in advance. We will not charge your credit or debit card until we dispatch your Gift Cards.


5.7 You will own the Gift Cards once payment for the Gift Cards has been received in full, including all applicable delivery charges.



6. USING A GIFT CARD


6.1 Gift Cards may be used to make purchases online through the Pandora UK Website and at any Participating Store.


6.2 To use an eGift Card in a Participating Store, print a copy of the eGift Card and present it when making your in-store purchase. To pay online using a physical Gift Card, type the unique 16 digit card number and six digit security code on the back of the Gift Card into the relevant box on the checkout page.


6.3 Gift Cards are valid for a period of 12 months starting on the date of purchase (clearly marked on the card), following which they expire automatically. A Gift Card cannot be used after the expiry date and any balance remaining upon expiry shall be lost. We have no obligation to remind or inform you of a Gift Card's expiry and it is your sole responsibility to ensure that any balance is used in full prior to expiry. Gift Card balances can be checked at any time using our online Balance Checker or upon presentation of the Gift Card in a Participating Store.


6.4 A Gift Card expires automatically once its balance has been exhausted. A Gift Card cannot be topped up with additional funds.


6.5 Gift Cards may be used to pay for the whole or any part of an in-store purchase or online order. Any balance which remains due may be paid using any other payment method accepted from time to time by the Pandora UK Website or the Participating Store where you are making your purchase.


6.6 You may use up to three Gift Cards in payment towards any single in-store purchase and one gift card online per order, provided that the total purchase or order value does not exceed £2,000.


6.7 These Gift Card Terms apply only to pounds sterling Gift Cards purchased from the Pandora UK Website or a Participating Store. Gift Cards purchased in accordance with these terms may not be used to make purchases in currencies other than pounds sterling or on any non-UK version of a Pandora website. Likewise, Gift Cards purchased outside England, Scotland, Wales, the Isle of Man and Jersey may not be used for purchases that are in pounds sterling or through the Pandora UK Website.


6.8 Gift Cards may not be used to purchase another Gift Card.


6.9 Purchases of Gift Cards do not count towards any qualifying spend relating to other online or in-store Pandora UK promotions or offers, including (by way of example only) any "gift with purchase" promotion.


6.10 Gift Cards may not be exchanged for cash. No change will be given when payment is made using a Gift Card and any unused balance will remain on the Gift Card for use in relation to future purchases.


6.11 A balance on an eGift Card can be transferred to a physical Gift Card and a balance on a physical Gift Card can be transferred to an eGift Card in a Participating Store.


6.12 Pandora UK reserves the right to refuse to accept a Gift Card as payment if there is reasonable evidence of tampering or fraud.



7. CANCELLATIONS AND RETURNS


Cancelling or Returning your Gift Card

7.1 Gift Cards may only be returned for a refund in accordance with your legal rights in circumstances where a Gift Card is not as described or is damaged or defective (other than as a result of being mishandled or used improperly by you). If you believe a Gift Card may be damaged, defective or not as described, please contact the Customer Care Team as soon as possible using the details at the end of these Gift Card Terms. 7.2 Gift Card purchases made through the Pandora UK Website may be cancelled at any time prior to dispatch. However, once you have received your dispatch confirmation email, it will be too late to cancel your purchase and prevent your order from being dispatched.


7.3 If you would like to cancel your Gift Card order before you have received your dispatch confirmation email, you must contact the Customer Care Team as soon as possible using the details at the end of these Gift Card Terms. Whilst the Customer Care Team will attempt to cancel your order prior to dispatch, this may not be possible due to the speed with which orders are processed.


7.4 Except as expressly set out in this clause 7, Gift Cards are non-returnable and non-refundable for any reason.



Returning Purchases made on your Gift Card

7.5 If you use a Gift Card or eGift Card to purchase goods online or in-store and you subsequently return the goods, any refund due to you will be made in the form of an eGift Card in the case of an online order or a physical Gift Card in the case of an in-store purchase.



7.6 Where you use a Gift Card or an eGift Card and another payment method in the same transaction, any refund due to you will be apportioned between a new Gift Card or eGift Card and the other method of payment you used until the initial payment amount is reached. For example:


- If you buy one piece of jewellery for £50 with a £20 Gift Card and pay the remaining £30 by debit or credit card, any refund due to you would be made in the same proportions – you would be given a new Gift Card with £20 credit and £30 would be refunded onto the debit or credit card used.

- If you buy three pieces of jewellery for £110 with a £60 gift card and £50 cash, and you return one piece of jewellery which is £40, you would be given a new Gift Card with £40 credit.



7.7 Please note that for online refunds, the minimum amount we can refund onto an eGift Card is £10. Any refund due to you of less than £10 will be refunded with a promotional code for use online only at the Pandora UK Website checkout.



8. LIABILITY TO YOU


8.1 You are solely responsible for the safe keeping and security of your Gift Card following delivery. If you damage, destroy or lose your Gift Card or your Gift Card is stolen or used by someone else (with or without your permission), Pandora UK shall not be liable for any loss or damage you suffer as a result except to the extent that such loss arises or Pandora UK's negligence or breach of these Gift Card Terms or the Pandora UK Website Terms and Conditions, in which event the party at fault shall be solely responsible.


8.2 The full extent of Pandora UK's liability shall be as set out in the Pandora UK Website Terms and Conditions and subject to any limitations and exclusions therein.


8.3 For the avoidance of doubt, nothing in these Gift Card Terms limits or excludes Pandora UK's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for defective products under section 2(3) of the Consumer Protection Act 1987 or for any other matter for which it would be illegal for Pandora UK to limit or exclude, or attempt to limit or exclude, liability.



9. DATA PROTECTION


9.1 Personal data relating to your purchase or use of a Gift Card or eGift Card will be used in accordance with current Data Protection Legislation and the Privacy Policy which can be found at: https://uk.pandora.net/en/privacy-policy/privacy-policy.html.



10. VARIATION


10.1 These Gift Card Terms may be amended from time to time without notice to you. It is your responsibility to check these Gift Card Terms from time to time to ensure you are aware of any changes which may have been made. In the event of changes, the "Last Updated" date at the top of these Gift Card Terms will be updated accordingly.


10.2 Pandora UK reserves the right at any time to cancel any Gift Card and/or suspend or permanently discontinue the Gift Card programme altogether if, in Pandora UK's sole discretion, such action is necessary. Such action may be necessary, for example, to make changes to the Gift Card programme, to comply with applicable law or regulation or as a result of circumstances beyond the reasonable control of Pandora UK.



11. GOVERNING LAW


11.1 These Gift Card Terms shall be governed by and construed in accordance with the laws of England, without resort to its conflict of law provisions. Any dispute or claim arising out of or in connection with these Gift Card Terms (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the English courts. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
